Terms of Service

Welcome to Fullpilot. These Terms of Service ("Terms") govern your access to and use of the Fullpilot platform, API, MCP server, and applications (collectively, the "Services") provided by Fullpilot, Inc. ("Fullpilot," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Acceptance of Terms

By creating an account or using Fullpilot, you confirm that you are at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the organization you represent.

2. Description of Services

Fullpilot is a local business data and outreach platform. It lets you search local businesses, reveal owner and operator contact details, export lead lists, enrich files you already have, integrate through our API and MCP server, and run AI SDR outreach campaigns. Some features, such as the AI SDR plan, are provided as a managed service that is set up with our team.

3. Account Registration and Security

To use our Services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials and API keys
  • Promptly notify us of any unauthorized access or security breach
  • Be responsible for all activity under your account and workspace

You may not share your credentials or allow unauthorized parties to access your account. You are responsible for keeping your API keys secret and may revoke them at any time.

4. Acceptable Use Policy

You agree not to:

  • Use the Services for any illegal or unauthorized purpose
  • Violate any applicable laws, regulations, or third-party rights
  • Send unlawful spam or violate anti-spam and outreach laws such as CAN-SPAM, the TCPA, GDPR, and CCPA
  • Contact people who have asked not to be contacted, or ignore opt-out and unsubscribe requests
  • Scrape, resell, redistribute, or build a competing dataset from data obtained through the Services
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or place an unreasonable load on the Services or API
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Remove or modify any proprietary notices, or use the Services to develop a competing product

5. Local Business Data and Your Responsibilities

The Services surface business listings and contact data from third-party providers and enrichment. This data is provided for your lawful business use. We work to provide useful, current data, but we do not guarantee that any record is accurate, complete, or suitable for a particular purpose.

You are solely responsible for how you use the data and for your outreach, including obtaining any consents required by law, honoring opt-out and do-not-contact requests, and complying with the marketing, privacy, and telecommunications laws that apply to you. You are also responsible for any messages, configurations, and campaigns you run through the Services.

6. Plans, Credits, and Payment

Fullpilot offers self-serve plans (Free, Starter, and Growth) and a sales-assisted AI SDR plan. Payments for self-serve plans are processed through Stripe.

  • Credits: Usage is metered in local business credits. Revealing a contact field (an email or a phone) costs one credit. Fields that are already unlocked by your workspace, or that cannot be found, are not charged.
  • Grants and expiration: Paid plans grant a batch of credits on each renewal. Credits do not roll over. Each renewal grants a fresh batch and unused credits from the prior period lapse.
  • AI SDR: The AI SDR plan is a managed service sold through a sales engagement rather than self-serve checkout. Its scope, volume, and fees are set out in your order or agreement.
  • Price changes: We may change pricing with 30 days' notice, effective on your next renewal.
  • Taxes: You are responsible for any taxes associated with your use of the Services, excluding taxes on our income.

7. Cancellation, Refunds, and Disputes

You may cancel a paid plan at any time from the billing page. When a subscription ends, your workspace stops receiving new credit grants, and previously unlocked contacts remain available while your account is active.

Fees are non-refundable except where required by law or expressly stated. If you believe you were charged in error or have a billing concern, contact us at contact@fullpilot.com before disputing the charge. Filing a payment dispute or chargeback will result in your workspace being suspended until the matter is resolved.

8. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. You retain rights to the data you provide, and we use it as described in our Privacy Policy and as needed to provide the Services. You represent that you have the necessary rights and permissions to provide any data you upload, including files you submit for bulk enrichment.

9. AI Agent Behavior and Compliance

We design our AI SDR and outreach features to operate within legal and ethical boundaries, but you are responsible for:

  • Ensuring your use of AI agents complies with applicable laws and regulations
  • Monitoring agent activities and communications
  • Reviewing and approving agent configurations and messaging
  • Maintaining compliance with industry-specific rules, including CAN-SPAM and the TCPA

10. Third-Party Services

The Services rely on third parties, including Stripe for payments, WorkOS for authentication, and DataForSEO and other providers for local business data. Your use of features that depend on these providers may also be subject to their terms. We are not responsible for third-party services we do not control.

11. Intellectual Property

The Services, including all software, models, designs, and content we provide, are owned by Fullpilot and protected by intellectual property laws. These Terms do not grant you rights to our trademarks, logos, or brand elements.

12. Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FULLPILOT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY BUSINESS DATA.

FULLPILOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO FULLPILOT IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Fullpilot, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Services, your outreach, or your violation of these Terms or applicable law.

14. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms or an open payment dispute. You may terminate your account at any time. Upon termination:

  • Your right to access the Services will cease
  • We may delete your data after a reasonable period, subject to legal retention requirements
  • You remain liable for all charges incurred before termination

15. Modifications to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Services. Your continued use of the Services after notice constitutes acceptance of the modified Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes will be resolved through binding arbitration in San Francisco, California, except that either party may seek injunctive relief in court.

17. Miscellaneous

  • Entire Agreement: These Terms, together with any order or service agreement, are the entire agreement between you and Fullpilot.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Our failure to enforce a right or provision is not a waiver of it.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms at any time.
